Terms & Conditions
Please ensure that you read the terms and conditions set out below in full and ask any questions prior to booking any treatments or procedures.
1. General terms for all clients
1.1 These terms form the basis of an agreement between Young Skin (us/our) and the Client (you/your).
1.2 Please read our privacy policy in full.
1.3 By registering with us, you agree to be bound by these terms and conditions.
2. Appointments/Deposits/Cancellations
2.1 When you book an appointment, we require you to pay in full, some or all of which we will be entitled to keep as set out in sub clause below:
2.2 If you cancel the appointment without giving us at least 48 hours’ notice prior to the appointment, you will forfeit your deposit.
2.3 We will not reserve any particular date and/or time which you request for any consultation or treatment unless you book an appointment for that time and date.
2.4 If you know you are going to be late for an appointment, you should contact Young Skin at your earliest. If you arrive more than 15 mins after your scheduled appointment time, we will try to provide the service/treatment/consultation you have booked, but if we decide that we cannot, the appointment will be treated as cancelled without notice by you and you will forfeit your deposit in full.
2.5 You may reschedule an appointment without charge if you give us at least 48 hours prior notice of the reschedule.
2.6 You may cancel an appointment without charge if you give at least 48 hours prior notice to the booked appointment. Deposit is non-refundable if less than 48 hours’ notice is given.
2.7 We may cancel an appointment booked by you at any time in the following circumstances:
2.7.1 The required practitioner/therapist and/or materials necessary for the provision of the consultation or treatment are not available; or
2.7.2 There is an event outside of our reasonable control; if we reschedule your deposit will be moved to your rescheduled appointment. If you choose not to reschedule your deposit will be refunded. Unfortunately, no other expense incurred due to the cancelled/rescheduled appointment will be given ie travel, accommodation etc.
2.7.3 We will use all reasonable endeavours to start all appointments on time as booked, but the start may be delayed by the overrun of a previous appointment or by other circumstances. Our practitioner/therapist will take the amount of time necessary to provide comprehensive care and attention to every single client and sometimes in complex or complicated cases this can result in delays. If a delay to the start is 30 minutes, or if at any time before or after you arrive for an appointment, we notify you that there will be a delay of at least that time, you may reschedule the appointment.
3. Fees & Payments
3.1 You must pay in accordance with our price list for all services on completion of the service/treatment that we have provided for you.
3.2 You may pay us for services (and for any deposit or other advance payment on account of that payment) using the following methods: Cash, Credit/Debit Card (excluding Amex), or Bacs payment/Bank transfer – Please note we never hold credit card information on file and will never ask you to reveal them to us.
3.3 If you choose to use any type of payment plan with any third party, this must be in place prior to an appointment or appointment will be cancelled.
3.4 We may alter prices without prior notice, however if the price of any service increases between the time you book an appointment and the date of the appointment, the price increase for those services will not apply to your appointment.
3.5 For any offers/discount - please see terms and conditions for those offers.
4. Eligibility for treatment
4.1 We will not provide treatments to you if you are under 18. We may require evidence of your age for that purpose.
4.2 We will not provide treatment if you are pregnant, think you are pregnant or are currently breast feeding.
4.3 We will not carry out treatment if we believe that you are under the influence of alcohol or any type of drug that may affect your decision-making ability.
4.4 We will not provide certain treatments to you if you have a medical condition or are taking medication that make that a treatment unsuitable for you.
4.5 We will not provide treatment to you if following your consultation, we believe that the treatment is not suitable for you or is not likely to be successful, as individuals differ in their response to, and the outcome of the treatment and have varied expectations.
4.6 We will not undertake a treatment or procedure that conflicts with any law in force, any voluntary or mandatory code of practice or any other similar rule or regulation.
5. Discounted/packages/offers
5.1 All treatments purchased as a course of treatment must be paid in full in advance or at the time of your first treatment.
5.2 All Discounted/package/offers must be used within 6 months of the date of purchase.
5.3 All Discounted/package/offers are non-refundable and non-transferable.
5.4 We do not offer a refund in the event of short term/temporary side effects such as reddening, bruising, swelling, mild burning, blistering or hypo/hyperpigmentation as well as very rare side effects such as scarring and permanent discolouration.
6. Botulinum Toxin Top up Reviews
6.1 Routine review appointments are offered as a courtesy. At this review you may be offered a complimentary top up if clinically required following the review.
6.2 Complimentary top up treatment is at the discretion of the practitioner/therapist and must be done within 2-3 weeks after the initial treatment. If you are unable to attend the review appointment within this time frame, no additional top up appointment will be provided.
7. Dermal fillers
7.1 Dermal filler top ups are all chargeable.
8. Children
8.1 Unfortunately, children cannot accompany you to any appointment. If you do bring any child with you the appointment will have to be cancelled and you will forfeit your deposit
8.2 We respectfully ask that all mobile phones are switched off or silenced. All photography or videography is unauthorised, and you will be asked to delete as you do not have our consent.
9. Refunds
9.1 Every effort will be made to ensure that you have the best possible outcome but as with all procedure there can be a spectrum of results. As individuals differ in their response to and the outcome of, the treatment and aftercare being followed, no clinical or financial guarantees can be given.
9.2 Treatment fees cannot be refunded in the case of a sub-optimal result including no result, or complications including allergic reactions, as all fees paid are related entirely to the services provided ie Product costs, expertise, professional time, consumables, and other costs incurred in providing the treatment irrespective of the results achieved.
9.3 Additional costs may occur should complications arise from the treatment and further treatment may be required.
10. Product Refunds
10.1 Products purchased in the clinic or over the phone are non-refundable unless they are faulty.
10.2 Faulty products will need to be returned for an assessment before a refund can be considered.
11. Risk of clinical complications
11.1 While we do our very best to ensure a satisfactory outcome, no clinical procedure is entirely risk free and the results of any procedure cannot be guaranteed. Expectations can vary and even carrying out every safety step there can still be risks. Every person is unique, and results can vary.
11.2 Although rare some procedures have well documented complications ie Vascular occlusions with Dermal Fillers. These can be discussed in your first consultation for each procedure.
11.3 If you experience a complication and need further assistance, please contact the clinic for support and you will be advised on steps to take and advised if you need to come back in.
11.4 Many complications can be managed simply and conservatively, and we will of course treat these to the best of our abilities and knowledge. However, in the unlikely event that your complication becomes more serious you may need further treatment outside of our expertise and you may need to be treated by the NHS or privately at your own cost. Most aesthetic treatments complications are not covered by medical insurance.
12. Equipment Safety
Your safety comes first. If at any time we discover or have concerns that any of our equipment or machines are not in proper working condition, we will ask you to reschedule your appointment and thank you for your understanding.
13. Documents & Records
13.1 All patients must complete a registration form and provide contact details including full name, date of birth, address, telephone number, and email address.
13.2 All patients must complete a medical questionnaire at their first appointment or prior to attending your first appointment, and you will be asked to sign to confirm that their details remain accurate and confirm that you will advise us of any changes; a review may be carried out from time to time.
13.3 All patients will be asked to sign a consent form prior to any treatment. You have the right to change your mind to treatment at any time, even after you have signed the consent form.
13.4 We will keep records for each patient registered with us.
13.5 You have the right to request a copy of any document which we may hold in relation to your care and which we will provide if you first pay a reasonable fee as determined by us.
13.6 Non-disclosure of any medical treatments or providing any false information on any of our questionnaires past, present and future will waive, discharge Young Skin and all its staff, employee, representatives, successors, contractors, affiliates from any and all liabilities, claims, demands, actions and causes of actions whatsoever, directly or indirectly arising out of or related to any loss, damage, injury or death, that may be sustained by me while participating in any activity or treatment while in our clinic or offsite while using any of the facilities that may lead to unintentional exposure or harm
14. Mental Health
14.1 It is important that all patients considering aesthetic treatments have realistic expectations that focus on improvement rather than perfection. Complications or less than satisfactory results are sometimes unavoidable, and/or may require additional treatments and can be stressful.
14.2 All patients must openly discuss with the practitioner/therapist prior to treatment, and history they may have of significant emotional depression, anxiety or mental health disorders.
14.3 Although many people may benefit psychologically from the results of aesthetic treatments, effects on mental health cannot be accurately predicted.
15. How we use your personal information - Data Protection
All personal information that we use will be collected, processed and held in accordance with provisions of EU Regulation2016/679 General Data Protection Regulation(‘GDPR’) / The Data Protection Act 2018 and your rights under the GDPR; For complete details of our collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of your rights and how to exercise them, and personal data sharing (where applicable), please refer to our privacy notice available from the clinic manager.
16. Limitation of Liability
16.1 Young Skin will not be liable in contract, tort, or otherwise for any economical loss (including without limitation, loss of profit) or for any other special indirect or consequential loss or damage arising out of, or in connection with, its provision of any services and/or goods to the client.
16.2 It is the client’s responsibility to ensure that he or she provide Young Skin with al the relevant medical details prior to each treatment. Young skin will not be liable for any damage that occurs as a result of the patient’s failure to disclose such details.
16.3 The patient agrees to comply with all instruction and/or recommendations given to them, or on behalf of Young Skin regarding their aftercare. Nothing in these Terms and Conditions shall exclude or limit, Young Skin’s liability for death or personal injury as a result of our breach of these Terms & Conditions or as a result of our negligence.
17. Feedback
We always welcome feedback from our clients. Whilst we always use all reasonable endeavours to ensure that your experience as a patient of ours is a positive one, we nevertheless want to hear from you if you have any cause for complaint. If you have a complaint, please raise this with your practitioner or therapist by phone or email. A copy of the complaints policy is available on request.
18. Changes to Terms and Conditions
We may from time to time change these Terms and Conditions without notice, but an up-to-date version will be available on our website.
19. No Waiver
No failure or delay by us or you in exercising and rights under the Terms and Conditions means that we or you have waived that right, and no waiver by us or you of a breach of any provision of these Terms and Conditions means that we or you will waive any subsequent breach of the same or any other provision.
20. Severance
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.
21. Law and jurisdiction
21.1 These Terms and Conditions, the Contract, and the relationship between you and us (whether contractual or otherwise) shall be governed by and construed in accordance with the laws of England and Wales.
21.2 Any dispute, controversy proceedings or claims between You and Us (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England & Wales.
22. Entire Agreement
22.1 These Terms and Conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations, and understandings between them, whether written or oral, relating to its subject matter.
22.2 Each party Acknowledges that in entering these Terms and Conditions it does not rely on and shall have no remedies in respect of any statement, representation, assurance, or warranty (whether made innocently or negligently) that is not set out in the Terms and Conditions. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in the Terms and Conditions
23. Third Party Rights
23.1 These Terms and Conditions do not give rise to any rights under the contracts (Rights of Third Parties) Act 1999 to enforce any term of the agreement.
24. Social Media Consent (to include, print paper, digital, video, and social media)
24.1 Upon you the client signing consent for his or her image to be used for promotional and social media use, you grant Young Skin and its designees the right in perpetuity to use your name, likeness, image, voice, appearance, and performance as embodied in the product whether recorded on or transferred to video files, photographs, audio tapes or other media, now known or later developed.
